Business and Booking Terms

1. Provider and scope

The provider is Sven Avmedoski - AVM Forge, Kadettengasse 29, 8041 Graz, Austria. These terms apply to the website and webshop packages, selected add-ons, and their online booking and payment.

A written order confirmation takes priority where it expressly records different or additional project details.

2. Review, booking, and contract formation

Before payment, the review shows package scope, selected add-ons, the net amount, VAT, and the total project price. Stripe’s final payment button clearly indicates the obligation to pay.

Successful payment makes the booking binding and forms the contract for the scope summarized in Checkout. AVM Forge sends the next steps and planned project start within one business day.

3. Electronic contract conclusion

The contract is concluded through these technical steps: configure the package, check the selection on the review page, proceed to the payment service Stripe, and complete the payment. Input errors can be corrected at any time before payment - on the review page by adjusting the selection and in Stripe before finally paying.

After payment, the contract text is sent by email together with the booking summary and the accepted version of these terms; the terms also remain available and storable on this website. The contract languages are German and English; if the versions differ, the German version controls.

4. Scope and customer cooperation

Scope follows the package description and checkout add-ons. Ongoing care and monthly retainers are not part of online payment and require a separate agreement.

The customer supplies content, approvals, access, and lawfully usable media on time. Late cooperation moves delivery dates reasonably. Work beyond confirmed scope is quoted before implementation.

5. Prices and payment

Project prices are stated net in euros; 20% Austrian VAT is shown alongside the price and in Checkout. The total shown in Stripe Checkout is not increased afterward.

Businesses in other EU countries with a valid VAT ID are not charged Austrian VAT – the reverse charge applies (Steuerschuldnerschaft des Leistungsempfängers). You can enter your VAT ID in Stripe Checkout.

Austrian businesses pay 20% VAT even with a UID; the reverse charge does not apply domestically. The amount is deductible as input VAT.

Booking charges the full package price together with any selected one-time add-ons. Stripe creates a paid invoice.

6. Timeline, revisions, and acceptance

The quoted timeline starts after successful payment and delivery of the agreed starting content. Included revision rounds follow the selected package.

AVM Forge submits the work for review. Defects must be described specifically. Mandatory statutory rights remain unaffected.

7. Rights, third-party components, and handover

After full payment, agreed rights in custom work are transferred. Open-source software, fonts, payment services, and other third-party components remain subject to their own licences and terms.

Code, agreed content, domain, and accounts are handed over as stated in the order confirmation. Portfolio use occurs only where legally and contractually permitted.

8. Hosting, care, and communication

Included hosting and support periods follow the package description. Later care does not renew automatically and requires a separate agreement.

Project notices and confirmations may be sent by email. Customers must keep their address current and check spam filtering.

1. Business status

Selecting “Business” confirms that the order relates to a trade, business, craft, or profession. Private individuals are governed by the consumer terms below instead.

2. Warranty, liability, and late payment

Business customers are subject to Austrian UGB warranty rules. Liability for slight negligence, consequential loss, lost profit, and data loss is excluded where lawful; gross-negligence liability is limited to typically foreseeable loss. Personal injury and mandatory liability are unaffected.

Statutory business default interest applies to late payment. Set-off and retention require an acknowledged or finally adjudicated claim.

3. Acceptance through production use

For business customers, production use of the delivered work counts as acceptance. Mandatory statutory rights remain unaffected.

4. Law and venue

Austrian law applies, excluding conflict rules and the CISG. For business customers, the competent court at AVM Forge’s registered location is agreed.

1. Pre-contract information and confirmation

Before payment, private customers receive essential characteristics, total price, expected performance time, contact details, and warranty and withdrawal information. The immediate payment email confirms the booking, selection, amount, applicable terms, and next steps on a durable medium.

2. Withdrawal

Consumers may generally withdraw from a distance service contract within 14 days without giving a reason. The period begins when the contract is concluded. Details, a model form, and an electronic request are available on the linked withdrawal page.

AVM Forge may begin project work after booking. Your statutory withdrawal rights remain unaffected by the start of work.

3. Statutory warranty and liability

Mandatory consumer warranty and liability rules apply without the B2B limitations. No limitation applies to personal injury, intent, gross negligence, or other mandatory claims.

4. Law and competent court

Austrian law applies without removing mandatory protections of the consumer’s country of habitual residence. Mandatory consumer venues apply to claims by or against consumers.
